Welcome to Sandbaggers Golf Spot ("Sandbaggers," "we," "our," or "us"). By accessing or using our facilities, website, or services, you agree to the following Terms & Conditions ("Terms"). Please read carefully, as these Terms govern your rights and responsibilities as a member, guest, or visitor.
1. General Terms
1.1. Acceptance of Terms
By using our services, you agree to these Terms and any additional terms and conditions that may apply to specific services or promotions.
1.2. Changes to Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting. Your continued use of our services after any changes constitutes your acceptance of the new Terms.
2. Use of Services
2.1. Eligibility
You must be at least 18 years old to use our services or be accompanied by a parent or legal guardian.
2.2. Reservations
- Reservations are recommended to ensure availability. Walk-ins are welcome based on availability.
- Tee times, simulator bays, or event spaces must be reserved in advance through our booking system (online, phone, or in-person).
- Guests must arrive on time. Late arrivals may result in shortened or forfeited sessions.
2.3. Equipment
Guests are responsible for the proper use of all equipment. Any damage to equipment caused by misuse will be the responsibility of the guest and may incur repair or replacement costs.
2.4. Code of Conduct
- All guests must behave respectfully toward staff, other members, and property.
- No abusive language, harassment, or unsafe behavior will be tolerated.
- Proper golf etiquette and simulator use must be followed.
- Sandbaggers reserves the right to remove any individual for misconduct without refund.
3. Payment & Cancellation
3.1. Pricing
Prices for our services are as stated on our website or in our facility and are subject to change without notice.
3.2. Payments
- All payments must be made in U.S. dollars by accepted forms of payment (cash, credit, or debit cards).
- Payment is due at the time of booking, unless otherwise stated in writing.
- Promotional pricing and discounts may not be combined unless expressly stated.
3.3. Cancellation Policy
- Cancellations made at least 12 hours in advance will receive a full refund.
- Cancellations made less than 12 hours in advance or no-shows will not be refunded.
- Refunds, when applicable, will be processed to the original payment method within 7–10 business days.
4. Liability
4.1. Assumption of Risk
Participation in golf and simulator activities involves inherent risks, including risk of injury. By using Sandbaggers facilities, you acknowledge and voluntarily assume all risks.
4.2. Waiver of Liability
Sandbaggers, its staff, and affiliates are not liable for personal injury, property damage, theft, or loss, except in cases of gross negligence or willful misconduct.
4.3. Indemnification
You agree to indemnify and hold harmless Sandbaggers, its owners, employees, and affiliates from any claims, damages, or expenses arising from your use of our services.
4.4. Responsibility for Health
Guests are responsible for their own health and physical condition when using the facility.
5. Minors
- Guests under 18 must be accompanied by a parent, guardian, or responsible adult unless otherwise authorized.
- Parents/guardians assume full responsibility for minors’ safety and conduct.
6. Privacy
6.1. Personal Information
We collect and use personal information in accordance with our Privacy Policy. By using our services, you consent to our collection and use of your personal information.
7. Security, Access Control & Video Surveillance
7.1. Video Surveillance
Sandbaggers Golf Spot utilizes video surveillance and security monitoring systems throughout the Facility twenty-four (24) hours per day, seven (7) days per week for the safety and security of members, guests, staff, equipment, and Facility property.
By entering the Facility, all members, guests, authorized users, instructors, and visitors acknowledge and consent to being recorded by video surveillance systems.
Members understand and agree that surveillance footage may be reviewed, retained, and utilized by Sandbaggers Golf Spot for legitimate business purposes, including but not limited to:
- Investigating accidents, injuries, or safety incidents.
- Resolving disputes between members, guests, instructors, or staff.
- Investigating theft, vandalism, unauthorized access, misuse of equipment, or property damage.
- Verifying compliance with Facility rules, membership agreements, and operating procedures.
- Supporting insurance claims.
- Cooperating with law enforcement, emergency responders, legal proceedings, or regulatory agencies when necessary.
Surveillance recordings remain the sole property of Sandbaggers Golf Spot and may not be released except as required by law or at the sole discretion of Sandbaggers Golf Spot.
7.2. No Expectation of Privacy
Members acknowledge that there is no expectation of privacy in common areas of the Facility, including simulator bays, putting areas, entrances, exits, hallways, and other shared spaces.
7.3. Access Control Monitoring
Facility access may be monitored and recorded through electronic access control systems. Entry and exit records may be reviewed in conjunction with surveillance footage to investigate security concerns, policy violations, equipment damage, unauthorized access, or other incidents.
7.4. Responsibility for Access Credentials
Members are solely responsible for all activity occurring under their assigned access credentials.
Sharing access credentials, allowing unauthorized individuals into the Facility, permitting tailgating through secured entrances, or otherwise providing Facility access to non-authorized persons is strictly prohibited and may result in immediate suspension or termination of membership without refund.
7.5. Security System Tampering
No individual may disable, obstruct, cover, alter, disconnect, damage, or interfere with any security camera, recording device, access control equipment, alarm system, networking equipment, or other security-related systems.
Any attempt to tamper with Facility security systems may result in immediate termination of membership, financial liability for damages, and referral to law enforcement.
7.6. Property Damage Investigations
Sandbaggers Golf Spot reserves the right to use surveillance footage and access records to identify individuals responsible for damage to equipment, simulators, furnishings, access systems, televisions, computers, or any other Facility property.
Members may be held financially responsible for damage caused by themselves, their guests, authorized users, or any individual granted access through their membership credentials.
7.7. Unstaffed Hours
Members acknowledge that Sandbaggers Golf Spot operates with self-service and unstaffed access periods. Staff may not be physically present during all operating hours.
Members voluntarily assume all risks associated with using the Facility during unstaffed hours and understand that immediate assistance may not be available in the event of an emergency, injury, equipment malfunction, or other incident.
8. Miscellaneous
8.1. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
8.2. Dispute Resolution
Any disputes arising under these Terms shall be resolved through binding arbitration in Santa Clara County, California.
8.3. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
8.4. Entire Agreement
These Terms constitute the entire agreement between you and Sandbaggers regarding your use of our services and supersede any prior agreements or understandings.
